Abstract
This study examines the principle of continuity (istishab) in Islamic jurisprudence as used by Imam Ibn al-Qassar in his book “Uyun al-Adillah”, given his frequent inferential use of it.
I begin with a brief biography of Ibn al-Qassar, followed by an analysis of his book “Uyun al-Adillah” in terms of its scholarly significance.
Then, I presented the definition of continuity according to legal theorists, the types of continuity as used by the author, and its applications in his books on jihad and marriage. I extract examples of his use of each type of continuity in these two books from “Uyun al-Adillah, and conclude my research with the most important findings and recommendations.
