Abstract
This research aims to demonstrate the impact of sectarian affiliation – both doctrinal and jurisprudential – on guiding issues of jurisprudence, through a study of examples from the book “Idah al-Mahsul min Burhan al-Usul” by Imam Abu Abdullah Muhammad al-Mazari, may God have mercy on him, in which he explains the book “Al-Burhan” by Imam al-Haramain Abu al-Ma'ali al-Juwaini, may God have mercy on him. On the doctrinal side, I addressed two issues: the first is the inclusion of the prohibition of the opposite of something in a command, and the second is whether the recommended is obligatory. As for the jurisprudential aspect, seven issues were mentioned, which icluded (1) the difference of opinion among scholars on interpreting an absolute command as repetition; (2) whether an absolute command requires immediate action or delay ; (3) a ruling on generality if it is based on a reason ; (4) the difference of opinion on the acceptance of reports ; (5) the issue of the sheikh denying what was narrated about him ; (6) the wording of the command ; and (7) the report of one person on a matter that is widespread.
